MKADI Messaging Terms of Service

These Messaging Terms of Service ("Messaging Terms") govern the SMS, MMS, RCS, and other mobile messaging services (collectively, the "Messaging Service") offered by Marwa Kadi LLC, doing business as MKADI ("MKADI," "we," "us," or "our").

By opting in to or otherwise consenting to participate in the MKADI Messaging Service, you agree to these Messaging Terms.

1. MKADI Messaging Service

The MKADI Messaging Service allows customers who affirmatively opt in to receive recurring SMS, MMS, RCS, and other supported mobile messages from or on behalf of MKADI at the mobile telephone number they provide.

Messages may include:

  • Promotional offers
  • Discounts and sales
  • Product announcements
  • Product recommendations
  • Special offers
  • Abandoned cart and checkout reminders
  • Order updates
  • Shipping notifications
  • Account alerts
  • Customer service communications
  • Other informational, transactional, and marketing communications from MKADI

Messages may be sent using automated technology where permitted by applicable law.

2. Consent to Receive Messages

By affirmatively opting in to the MKADI Messaging Service, you consent to receive recurring SMS, MMS, RCS, or other supported mobile messages from or on behalf of MKADI at the mobile telephone number you provided.

Consent to receive marketing messages is not a condition of purchasing any goods or services from MKADI.

Participation in the MKADI Messaging Service is voluntary.

Providing your telephone number for shipping, billing, order fulfillment, account management, or customer service purposes does not by itself constitute consent to receive marketing messages.

3. Message Frequency

Message frequency varies.

The number and frequency of messages you receive may depend on your purchases, account activity, interactions with MKADI, promotions, and marketing preferences.

4. Message and Data Rates

Message and data rates may apply.

MKADI does not charge you to participate in the Messaging Service. However, your wireless carrier or service provider may charge you for sending or receiving messages or using mobile data according to your wireless plan.

You are responsible for any charges imposed by your wireless carrier or service provider.

Contact your wireless carrier for information regarding your messaging and data plan.

5. How to Opt Out

You may opt out of receiving MKADI marketing messages at any time by replying:

STOP

to a MKADI marketing message.

Where available, you may also use an unsubscribe link contained in a message.

After submitting an opt-out request, you may receive a one-time confirmation message confirming that you have been unsubscribed.

After your opt-out request has been processed, you will no longer receive marketing messages from that messaging program unless you subsequently provide consent again.

If you participate in multiple separate MKADI messaging programs, you may need to opt out of each program separately where permitted by applicable law.

7. Wireless Carriers and Message Delivery

Wireless carriers are not responsible or liable for delayed or undelivered messages.

Message delivery is subject to effective transmission by your wireless carrier, mobile network, messaging provider, device, and other telecommunications providers.

MKADI does not guarantee that every message will be delivered or received within a particular period of time.

The Messaging Service may not be available through all wireless carriers, mobile devices, networks, or geographic locations.

8. Mobile Number Requirements

You agree to provide MKADI with a valid mobile telephone number.

If you change, transfer, or discontinue your mobile number, you should update your information with MKADI or opt out of the Messaging Service before discontinuing use of that number where reasonably possible.

If you obtain a new mobile number and wish to receive MKADI marketing messages at that number, you may be required to opt in again.

9. Changes to Messaging Numbers

MKADI or our messaging service providers may change the telephone number, short code, toll-free number, RCS sender, or other sending identifier used to operate the Messaging Service.

We will take reasonable measures to process opt-out requests in accordance with applicable requirements.

10. Privacy

Your participation in the MKADI Messaging Service is subject to our separate Privacy Policy.

We may collect information necessary to operate the Messaging Service, including your mobile telephone number, consent records, subscription status, opt-out requests, message delivery information, and interactions with our messages.

We may use third-party messaging, telecommunications, and technology service providers to operate and support the Messaging Service on our behalf.

SMS, MMS, and RCS opt-in information and consent will not be sold or shared with third parties for their own independent marketing purposes.

Service providers assisting MKADI with the Messaging Service may process information on our behalf as necessary to provide those services.

11. Changes to the Messaging Service

MKADI may modify, suspend, or discontinue the Messaging Service or any of its features from time to time, subject to applicable law.

We may also update these Messaging Terms.

When we make changes, we will update the "Last Updated" date at the top of this page.

12. Disclaimer

To the extent permitted by applicable law, MKADI is not responsible for failed, delayed, or misdirected delivery of messages resulting from circumstances outside our reasonable control, including wireless carrier, telecommunications network, messaging platform, device, or service provider failures.

Nothing in these Messaging Terms limits rights or remedies that cannot legally be limited or excluded.

13. Governing Law

These Messaging Terms are governed by applicable federal law and, to the extent applicable, the laws of the State of Texas, without regard to conflict-of-law principles.

Nothing in this section limits any consumer protection rights that apply to you under applicable law.
